Below are some of the key legal concepts that will serve as foundational through our journey of the rules regarding Criminal Evidence and Procedure. After reviewing all of the assigned reading and supplemental material, you are to create a Powerpoint type presentation addressing each of the below topics:
Explain the concepts of Substantive Criminal Law and Criminal Procedure. Give at least two practical examples of each category and explain them in your own words.
Within our United States Constitution, which 4 or 5 Amendments are the key protections and guide the actions of law enforcement and the Criminal Justice Court system? Support WHY you chose each of those amendments and believe each is crucial to Criminal Evidence and Procedure.
Define what the phrase “elements of a crime” mean. Then discuss and explain in your own words each of the three required elements for crimes in general ( actus reus, men’s rea, concurrence).
Finally, consider each of the below situations based on the following scenario and identify which has all the elements for a criminal charge:
Sally goes to a party and sees someone she has always hated on the other side of the room talking to her friends and laughing. Sally has a gut feeling that her nemesis is making fun of her and that all of Sally’s friends are now laughing at her as well. Sally decides to kill her nemesis. Consider each of these scenarios and discuss if all the elements of a crime are met. SUPPORT YOUR ANSWER.
a. Sally tells some people that she wants to kill her nemesis but leaves without actually approaching her.
b. Sally tells two people that she wants to kill her nemesis. Sally then gets a shotgun and brings it into the party, but gets nervous and leans it against the wall. The shotgun falls over, goes off, and kills someone other than the person Sally intended.
c. Sally tells no one of her desire to kill this person, but she goes and gets a gun and shoots the nemesis dead in front of everyone at the party.
d. Sally tells 3 friends of her desire to kill this person. Sally gets in her car to go get the gun, puts on her seat belt, turns on the lights, and windshield wipers, backs out of the parking spot, and runs over her nemesis that had left the party and was on her bike on the sidewalk behind Sally with no lights or reflectors. She falls, hits her head, and dies.
